USERRA Protects Your Rights to Your Civilian Job

The Uniformed Services Employment and Reemployment Rights Acts of 1994 (USERRA) protects you from discrimination whether you work in the public or private sector, or even in a federal job. When an employee returns from any extended period of active service, he or she is not an "at will" employee. This means that you cannot be terminated within one year of returning to work, except for good cause.

USERRA applies to service people in the National Guard and Reservists. It entitles you to:

  • Reinstatement at the same level job as when you left
  • Similar treatment to those who did not serve, such as promotions or pay raises
  • Time off to attend mandatory weekend drills
  • Time off for required yearly training duty - you cannot be required to use your vacation time for mandatory training
