Educating employees about discrimination in Northern California

Employee discrimination occurs when an employer treats an employee differently from other employees due to a protected status, such as race, gender or nationality. An employer can perpetrate discrimination in numerous ways, such as by showing favoritism toward employees of a certain ethnicity, by severely slandering an employee or by making unwanted sexual advances. Several different categories of employment discrimination include:

Each form of discrimination is atrocious and should be dealt with immediately. If you believe that you have been a victim of employee discrimination recently or in the past, you should promptly seek legal advice about what your proper course of action should be. At Smith Johnson Inc., we provide the greatest possible attention and care for your case.

Defining employees' rights

One of the most common questions people ask us is how to know if their employers' actions are discriminatory according to the law. Though every case is different, and you should consult with an experienced labor law firm to talk about the specific facts of your case, employers are bound to follow certain rules to prevent discrimination. If an employer has violated one of these rules, you may have a basis for a discrimination lawsuit. Your employer must abide by these rules:

  • An employer must treat employees and potential employees in a nondiscriminatory manner when recruiting, hiring, firing and verifying their identity and authorization to work.
  • An employer must not require an employee to take action or omit action that contradicts an employee's religious beliefs.
  • Your employer may not subject you to a work environment that is hostile.
  • Your employer must provide you with the complete Employment Eligibility Verification Form I-9, including instructions for completing it.
  • An employer must accept your documentation if it reasonably appears to be genuine and to relate to you.
  • Your employer must allow you the choice of what documentation to provide. In other words, your employer cannot demand that you provide a U.S. passport, immigration visa or green card.
  • Your employer cannot reject any document that does not reasonably appear to be genuine or to relate to you.
  • Your employer cannot legally retaliate against you for filing a discrimination claim or for cooperating in the investigation of a co-worker's claim.

We do not hesitate to sue big employers and have filed employment-related lawsuits against, among others, the following employers: Bank of America, Met Life, Cingular, AT & T, Longs Drugs, Safeway, Starbucks, Save Mart, Sams Club, Wal Mart, Denny’s, Sky West Airlines, Time Warner, PG & E, Microsoft, Kentucky Fried Chicken, Best Buy, Alhambra Water, Ahern Rentals, Little Caesars, Harris Ranch, the Fresno Unified School District, and the Fresno Police Department.
